(The Turkish Post) –<\/strong> Resmi Gazete’nin bug\u00fcnk\u00fc say\u0131s\u0131nda yer alan karara g\u00f6re, m\u00fcteahhitlik yapan K.K, kat maliklerinin onay\u0131n\u0131 almadan dubleks daireleri 4 ayr\u0131 daireye d\u00f6n\u00fc\u015ft\u00fcrd\u00fc. Durumun tapu dairesine bildirmesi \u00fczerine taraflar aras\u0131nda husumet olu\u015ftu. Bunun \u00fczerine K.K, sosyal medyadan i\u00e7inde “noni\u015f” ile “nono\u015f” ifadeleri ge\u00e7en bir payla\u015f\u0131mda bulundu. Kat maliklerinden L.K’nin, s\u00f6z konusu payla\u015f\u0131m\u0131n kendisini hedef ald\u0131\u011f\u0131 \u015fikayeti \u00fczerine K.K, hakaret su\u00e7undan yarg\u0131land\u0131 ve 1740 lira adli para cezas\u0131na \u00e7arpt\u0131r\u0131ld\u0131.<\/p>\n

Hakk\u0131ndaki mahkumiyet h\u00fckm\u00fcn\u00fcn kesinle\u015fmesi \u00fczerine K.K, hak ihlali iddias\u0131yla Anayasa Mahkemesi’ne bireysel ba\u015fvuruda bulundu. Y\u00fcksek Mahkeme, ba\u015fvurucunun Anayasa’n\u0131n 26. maddesinde g\u00fcvence alt\u0131na al\u0131nan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc hakk\u0131n\u0131n ihlal edildi\u011fine h\u00fckmetti.<\/p>\n

KARARIN GEREK\u00c7ES\u0130NDEN<\/strong><\/p>\n

\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn bir dereceye kadar abart\u0131ya, hatta k\u0131\u015fk\u0131rtmaya izin verecek \u015fekilde geni\u015f yorumlanmas\u0131 gerekti\u011fi belirtilen kararda, sosyal medya payla\u015f\u0131m\u0131ndaki ifadelerin kaba ve k\u0131r\u0131c\u0131 oldu\u011fu de\u011ferlendirilse dahi toplumda bireylerin birbirlerine kaba ve k\u0131r\u0131c\u0131 s\u00f6zler sarf etti\u011fi her olayda adli ceza ile mahkemelerin ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne m\u00fcdahale etmelerinin beklenmemesi gerekti\u011fi vurguland\u0131.<\/p>\n

Kararda, “Sosyal medyadan her kaba yahut k\u0131r\u0131c\u0131 payla\u015f\u0131m sebebiyle ceza mahkumiyetine otomatik olarak karar verilmesi demokratik toplumun vazge\u00e7ilmez unsuru olan ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc \u00fczerinde cayd\u0131r\u0131c\u0131 etki do\u011furacakt\u0131r” belirtildi.<\/p>\n

Mahkemenin, sadece “noni\u015f” kelimesinin hakaret niteli\u011finde oldu\u011fu sonucuna ula\u015ft\u0131\u011f\u0131, ba\u015fvuruya konu olay dikkate al\u0131nd\u0131\u011f\u0131nda bunun “a\u015f\u0131r\u0131 yorum” oldu\u011fu belirtilen kararda, \u015fu de\u011ferlendirme yer ald\u0131:<\/p>\n

“Mahkemenin, ba\u015fvurucunun sarf etti\u011fi ‘noni\u015f’ ile ‘nono\u015f’ kelimelerinin ayn\u0131 manada olup homoseks\u00fcel erkekler i\u00e7in kullan\u0131ld\u0131\u011f\u0131n\u0131 de\u011ferlendirmesi ve ba\u015fvurucunun as\u0131l amac\u0131n\u0131n m\u00fc\u015ftekiyi k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcrmek oldu\u011funu kabul etmesi ancak ba\u015fvurucunun kulland\u0131\u011f\u0131 kelimelere onun verdi\u011fi anlam\u0131n \u00f6tesinde anlamlar y\u00fckleyerek m\u00fcmk\u00fcn olmu\u015ftur. Anayasa Mahkemesinin alt\u0131n\u0131 \u00e7izdi\u011fi \u00fczere ihtilafl\u0131 ifadelere ba\u015fvurucunun verdi\u011fi anlam\u0131n \u00f6tesinde bir anlam y\u00fcklenmemelidir. Mahkeme gerek\u00e7esinin ba\u015fvurucunun ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne yap\u0131lan m\u00fcdahale y\u00f6n\u00fcnden ilgili ve yeterli olmad\u0131\u011f\u0131 de\u011ferlendirilmi\u015ftir.<\/p>\n
