Adalet Divan\u0131\u2019n\u0131n bu karar\u0131, Avrupa\u2019da isteyen kamu kurumlar\u0131n\u0131n, ba\u015f\u00f6rt\u00fcs\u00fc yasa\u011f\u0131 uygulayabilmesinin de \u00f6n\u00fcn\u00fc a\u00e7t\u0131.<\/p>\n<p>Euronews T\u00fcrk\u00e7e\u2019deki habere g\u00f6re; Bel\u00e7ika\u2019n\u0131n do\u011fusundaki Liege kentine ba\u011fl\u0131 Ans Belediyesi\u2019nin bir kad\u0131n \u00e7al\u0131\u015fan\u0131na i\u015f yerinde ba\u015f\u00f6rt\u00fcs\u00fc takamayaca\u011f\u0131n\u0131 bildirmesi \u00fczerine ilgili \u00e7al\u0131\u015fan konuyu mahkemeye intikal ettirmi\u015fti.<\/p>\n<p><strong>AYRIMCILIK VE \u00d6ZG\u00dcRL\u00dc\u011e\u00dcN \u0130HLAL\u0130 NEDEN\u0130YLE DAVA A\u00c7TI<\/strong><\/p>\n<p>Ancak kad\u0131n \u00e7al\u0131\u015fan\u0131n \u2018dini \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn ihlali\u2019 ve \u2018ayr\u0131mc\u0131l\u0131k\u2019 gerek\u00e7esiyle ba\u015fvurdu\u011fu Liege \u0130\u015f Mahkemesi bu konuda h\u00fck\u00fcm veremedi.<\/p>\n<p>Bunun \u00fczerine konu Avrupa Adalet Divan\u0131\u2019na ta\u015f\u0131nd\u0131.<\/p>\n<p>Bu arada belediye istihdam ko\u015fullar\u0131n\u0131 de\u011fi\u015ftirerek, \u00e7al\u0131\u015fanlar\u0131n\u0131n dini veya ideolojik inan\u00e7lar\u0131na dair a\u00e7\u0131k i\u015faretler ta\u015f\u0131mamak suretiyle tarafs\u0131zl\u0131k sergilemelerini zorunlu k\u0131ld\u0131.<\/p>\n<p><strong>KAMU KURUMLARI \u0130Z\u0130N VERSE DE VERMESE DE HAKI OLACAK<\/strong><\/p>\n<p>AB Avrupa Adalet Divan\u0131, \u201cbir kamu kurumunun, kendi b\u00fcnyesinde tarafs\u0131z bir idari ortam olu\u015fturmak amac\u0131yla \u00e7al\u0131\u015fanlar\u0131na dayatt\u0131\u011f\u0131 tarafs\u0131zl\u0131k politikas\u0131n\u0131n, me\u015fru bir ama\u00e7la nesnel olarak hakl\u0131 g\u00f6r\u00fclebilece\u011fi\u201d y\u00f6n\u00fcnde karar verdi.<\/p>\n<p>Ayr\u0131ca mahkeme, ba\u015fka bir kamu idaresinin, genel ve ayr\u0131m g\u00f6zetmeyecek bir \u015fekilde, g\u00f6r\u00fcn\u00fcr inan\u00e7 i\u015faretlerinin tak\u0131lmas\u0131na izin vermeye karar vermesi halinde de hakl\u0131 olabilece\u011fini kaydetti.<\/p>\n<p>Mahkemenin karar\u0131nda her AB \u00fcyesi devletin ve devlete ba\u011fl\u0131 idarelerin i\u015f yerlerinde te\u015fvik etmeyi ama\u00e7lad\u0131klar\u0131 kamu hizmetinin tarafs\u0131zl\u0131\u011f\u0131n\u0131 tasarlama konusunda takdir yetkisine sahip oldu\u011fu belirtildi.<\/p>\n<p>Kararda, \u201cAncak bu hedefe tutarl\u0131 ve sistematik \u015fekilde ula\u015f\u0131lmal\u0131. Hedefe ula\u015fmak i\u00e7in benimsenen \u00f6nlemler, kesinlikle \u2018gerekli\u2019 olanlarla s\u0131n\u0131rl\u0131 kalmal\u0131.
