New York’taki \u0130kinci Temyiz Mahkemesi, T\u00fcrkiye’den \u00e7al\u0131narak ABD’ye getirilen ve m\u00fczayede evi Christies’de sergilenen 6 bin y\u0131ll\u0131k Y\u0131ld\u0131z Avc\u0131s\u0131 heykelinin iadesi talebini reddetti.<\/p>\n

\u00dcst mahkemede, T\u00fcrkiye’nin, mermer heykelci\u011fin \u00e7al\u0131nd\u0131\u011f\u0131n\u0131 bildirmek i\u00e7in \u00e7ok uzun s\u00fcre beklemesi \u00f6ne s\u00fcr\u00fclerek, antik buluntunun milyarder i\u015f insan\u0131 Michael Steinhardt’tan al\u0131namayaca\u011f\u0131na h\u00fckmedildi.<\/p>\n

Temyiz Mahkemesinin a\u00e7\u0131klamas\u0131nda, T\u00fcrkiye’nin, 1990’larda tarihi kad\u0131n heykelci\u011finin, topraklar\u0131ndan yasa d\u0131\u015f\u0131 \u015fekilde \u00e7\u0131kar\u0131lm\u0131\u015f olabilece\u011fini bilmesi i\u00e7in nedenleri oldu\u011fu, nisan 2017’de Christies taraf\u0131ndan sat\u0131\u015fa \u00e7\u0131kar\u0131l\u0131ncaya kadar dava a\u00e7mad\u0131\u011f\u0131 i\u00e7in haklar\u0131n\u0131 kullanmad\u0131\u011f\u0131 belirtildi.<\/p>\n

Bir alt mahkeme de 2021’deki duru\u015fmada, 22,9 santimetre boyundaki heykelci\u011fin T\u00fcrkiye’ye iadesini reddetmi\u015f, dava temyize ta\u015f\u0131nm\u0131\u015ft\u0131.<\/p>\n

Mahkeme, Kiliya tipi idollerin Anadolu d\u0131\u015f\u0131nda ba\u015fka \u00fclkelerde yap\u0131lan kaz\u0131larda bulunmam\u0131\u015f olmas\u0131, bu eserin devlet mal\u0131 olmas\u0131, Michael Steinhardt’\u0131n mermer idol\u00fc T\u00fcrkiye\u2019den ka\u00e7\u0131r\u0131lan Lidya Hazineleri’ni satt\u0131\u011f\u0131 bilinen JJ Klejman isimli tacirden sat\u0131n alm\u0131\u015f olmas\u0131 ve duru\u015fma s\u0131ras\u0131nda Steinhardt’\u0131n eserin k\u00f6keninin T\u00fcrkiye oldu\u011funu bildi\u011fini inkar etmemesine ra\u011fmen iade talebini kabul etmemi\u015fti.<\/p>\n
