Kak\u0131c\u0131\u2019n\u0131n \u201ckamu g\u00f6revlisine sesli yaz\u0131l\u0131 veya g\u00f6r\u00fcnt\u00fcl\u00fc bir ileti ile hakaret\u201d etti\u011fi ileri s\u00fcr\u00fcld\u00fc.<\/p>\n<p>Basit yarg\u0131lama usul\u00fc ile dosya \u00fczerinden yap\u0131lan yarg\u0131lamada Kak\u0131c\u0131 beraat etti. Kak\u0131c\u0131\u2019ya verilen beraat karar\u0131n\u0131n ard\u0131ndan eski \u0130\u00e7i\u015fleri Bakan\u0131 Soylu, avukat\u0131 U\u011fur K\u0131z\u0131lca arac\u0131l\u0131\u011f\u0131yla karara itiraz etti.<\/p>\n<p>Kabul edilen itiraz\u0131n ard\u0131ndan 13 Eyl\u00fcl\u2019de \u00c7e\u015fme 3. Asliye Ceza Mahkemesi\u2019nde g\u00f6r\u00fclen duru\u015fmada san\u0131k Kak\u0131c\u0131 ve avukat\u0131 Tacettin \u00c7olak haz\u0131r bulundu. Duru\u015fmada Kak\u0131c\u0131, \u201cYazd\u0131klar\u0131m\u0131n hakaret olu\u015fturdu\u011funu d\u00fc\u015f\u00fcnm\u00fcyorum\u201d dedi ve beraatini talep etti.<\/p>\n<p><strong>BERAAT KARARI VER\u0130LD\u0130<\/strong><br \/>\nAl\u0131nan savunma ve beyanlar\u0131n ard\u0131ndan karar\u0131n\u0131 a\u00e7\u0131klayan mahkeme, san\u0131k Kak\u0131c\u0131\u2019n\u0131n \u00fczerine at\u0131l\u0131 su\u00e7un unsurlar\u0131n\u0131n olu\u015fmad\u0131\u011f\u0131 gerek\u00e7esiyle beraatine h\u00fckmetti.<\/p>\n<p>Konuya ili\u015fkin Cumhuriyet\u2019e konu\u015fan avukat \u00c7olak, \u201cHakaret su\u00e7lamalar\u0131yla bug\u00fcne kadar kendim dahil onlarca m\u00fcvekkilime davalar a\u00e7\u0131lm\u0131\u015ft\u0131r. TCK\u2019nin 125\u2019inci maddesi ve 299\u2019uncu maddesi iktidar\u0131n yanl\u0131\u015f ekonomik-siyasal uygulamalar\u0131n\u0131 ele\u015ftiren vatanda\u015flar\u0131m\u0131z\u0131 korkutman\u0131n ve susturman\u0131n arac\u0131 olarak kullan\u0131lmaktad\u0131r\u201d dedi.<\/p>\n<p><strong>\u2018\u00c7E\u015eME\u2019DE HAK\u0130MLER VARMI\u015e\u2019<\/strong><\/p>\n<p>\u201cSiyasi makamlarda g\u00f6rev alan ki\u015filerin a\u011f\u0131r ele\u015ftiriler dahil her t\u00fcrl\u00fc ele\u015ftiriye katlanmalar\u0131 gerekir\u201d diyen \u00c7olak, \u201cHi\u00e7bir \u015fekilde su\u00e7 olu\u015fturmayacak payla\u015f\u0131mlardan \u2018hakaret\u2019 su\u00e7u \u00e7\u0131kartan savc\u0131lar\u0131n hukuk bilgisinden \u015f\u00fcphe ederim. \u00d6rne\u011fin, \u00c7e\u015fme\u2019deki yarg\u0131lamada ya\u015fad\u0131\u011f\u0131m\u0131z gibi m\u00fcvekkilimizin \u00f6znesiz bir ifade ile \u2018Bunlara m\u00fcdahale etmeyen \u015ferefsizdir\u2019 \u015feklindeki payla\u015f\u0131m\u0131n\u0131 Soylu\u2019ya hakaret olarak yorumlanmas\u0131 inan\u0131l\u0131r gibi de\u011fil.
